If you missed the deadline in Oklahoma

A default judgment means the court decides against you because you didn't answer. You may be able to ask the court to set it aside (cancel it), but time limits are short.

What happens

If you do not answer a regular case in time, or do not appear on the small claims date, the court can enter a default judgment against you.

How to set it aside (cancel it)

File a motion to vacate within 30 days after the judgment is filed (longer if the court did not mail you a copy when required). After 30 days, you must file a petition to vacate: within 2 years for fraud by the winning party or unavoidable casualty or misfortune that kept you from defending; within 3 years for clerk mistakes or irregularity in obtaining the judgment. A void judgment can be vacated at any time.

Law: 12 O.S. §§ 1031, 1031.1, 1038

If there is a judgment in Oklahoma

A judgment is the court's decision that you owe money. Then the creditor can ask the court to take money from your pay or bank account.

Interest after the judgment

Post-judgment interest is the prime rate (first Wall Street Journal of the year) plus 2%, certified each January, and recalculated each calendar year the judgment stays unpaid. If your contract sets an interest rate, that contract rate applies instead (up to the lawful rate) and is stated in the judgment.

How long it lasts

A judgment becomes unenforceable if 5 years pass without an execution, a notice of renewal, a garnishment summons or an income assignment. Each of these restarts the 5 years, so a creditor can keep it alive.

Law: 12 O.S. §§ 727.1(C), (D), (I), 735

Garnishment, bank levy and exemptions in Oklahoma

Exempt means protected by law: money or property the creditor can't take. Often you must claim it yourself, fast.

Wage garnishment (taking part of your pay)

The federal limit applies. You keep 75% of wages earned in the last 90 days, and federal law also protects 30 times the federal minimum wage per week. If you support a family, you can ask the court to protect more because of undue hardship.

Law: 31 O.S. § 1(A)(18); 31 O.S. § 1.1

Bank levy (freezing and taking money in your bank account)

The creditor gets a garnishment summons served on your bank. The bank must mail or hand you a notice of garnishment and exemptions and an application to request a hearing. Social Security and other exempt funds can be claimed.

How to claim an exemption

File the claim for exemption / application for hearing (the form that comes with the garnishment notice) with the court clerk within 5 days after you receive the notice. The court sets a hearing 2 to 10 days after it gets your application; you must show the money is exempt. After 5 days, you can still raise an exemption by motion.

Law: 12 O.S. §§ 1172.2(A), 1174(C)
