How long you have to answer in Illinois
- Summons gives a court date: by the date on your summons.
- Summons says 30 days: 30 days.
It depends on your summons. If it gives a court date (claims of $50,000 or less), file your Appearance (and Answer, if required) before that date or go to court on that date; if you file only an Appearance, you have 10 days after the court date to file an Answer unless the judge sets another time. In small claims ($10,000 or less), an Answer is not required unless the judge orders one, but you must come to court. If the summons says 30 days, file your Appearance and Answer within 30 days after you were served, not counting the day of service.

Defenses to know in Illinois
The statewide Affirmative Defenses form lists examples such as the plaintiff waiting longer than the law allows to sue, and the claim already being decided in an earlier case. The limit for written contracts is 10 years and for unwritten contracts 5 years. In credit card and debt buyer cases, missing paperwork under Rule 280.2 blocks a default judgment.
Law: 735 ILCS 5/2-613; 735 ILCS 5/13-206, 13-205; Rule 280.4
Illinois allows 10 years to sue on a written contract. If the debt is older, say so in your answer: the court usually won't raise it for you.
